- Nick Diaz may not be fighting in the Octagon any time soon, but that doesn’t mean he isn’t looking for a fight.
The embattled UFC welterweight is still sitting under a temporary suspension handed down from the Nevada State Athletic Commission after he tested positive for marijuana following his February bout against Carlos Condit at UFC 143.
Since that time, Diaz has been awaiting a full hearing from the Nevada State Athletic Commission to have his chance to prove his case, and finally receive a judgment regarding his potential suspension.
On April 24, Diaz’s lawyer, Ross Goodman filed a lawsuit against the commission claiming that the constant delays have violated Diaz’s rights in regard to a timely proceeding to hear his arguments for the temporary suspension, and asking for a full dismissal of charges after the lengthy delay.
The lawsuit was first reported by MMAFighting.com on Thursday.
The Diaz camp has long attacked the initial suspension by the commission claiming that marijuana metabolites, which is what Diaz tested positive for following his fight, are not actually on the banned substances list provided by the commission.
They filed a second motion against the commission after they alleged Diaz lied on a pre-fight questionnaire in which he answer that he was taking no prescription or over the counter drugs. Goodman’s argument was that a medicinal marijuana card, which Diaz legally has in the state of California, is not by definition a prescription nor something that could be purchased over the counter in the state.
Now with this latest shot fired, Goodman is calling for the commission’s delays and lack of setting a date for a hearing to result in the dismissal of the charges against Diaz all together.

| Goodman is a lawyer... he is not there to "whoop ass" he's there to make money off of Nick. As soon as Nick runs out of money he will also run out of lawyer.
Maybe Nick has a case, good luck in court.
A faster hearing one way or another would be beneficial to both Nick and the sport. If the commission is moving so slowly because their marijuana rule is crap then they need to admit that, change it, make it stronger, make it make sense. If so cut Nick loose from the suspension and let everybody get back to making money... everybody that is except the lawyers.
I wonder how deep Nicks pockets are right now cause if it does go to court it could be very very expensive and really long and drawn out. | |

Nick is trying to sue you NSAC, becuase he got high, because he got high, becuase he got hiiiiigh.

| Yeah that's the problem here; how much is this gonna cost? This lawyer is doing what he's supposed to be doing, and that's finding holes in the rules (and he's doing it extremely well, I might add). But if this keeps going on and on, at what point is it not worth it anymore?
However, I gotta disagree that when the Diaz camp gets low on funding, Goodman will bail. He's getting more than money out of this; he's getting exposure. And maybe it's just me, but it seems like this case has gotten at the very least a little bit personal between Goodman and the commission. I think it's gonna take a serious falling out between lawyer and client if he's gonna just leave and let the commission get the W on this. | |

Nick Diaz can't quit fighting. It's not possible!
He "quit" because Condit ran from him and won a decision. He was pissed and annoyed. He wants to fight, not compete in a point-fest.
He'll be back. The UFC will find someone to "fight" him, not compte wuth him in a point contest. | |
